Consent Agreement
In two decisions dated October 31, 2024, a panel of the NANB Complaints Committee accepted a Consent Agreement between NANB and Tonya McAllister (Registration Number 026836). In response to the two complaints filed against her regarding the same incident, Ms. McAllister admitted to refusing to visit a patient in respiratory distress at his residence after dark to perform an assessment because his residence was in an Indigenous community. Ms. McAllister admitted that she violated NANB’s Standards for the Nurse-Client Relationship and the Canadian Nurses Association’s Code of Ethics for Registered Nurses, specifically the provisions that stipulate that nurses must refrain from discriminating based on a person’s race, ethnicity, culture, place of origin, or any other attribute.
Ms. McAllister has voluntarily agreed to the following conditions on her registration:
- Undertaking to cease practicing as a nurse for a period of two (2) months;
- Completing the Indigenous Reconciliation Awareness Module (IRAM) Training offered by the Joint Economic Development Initiative and completing the Code of Ethics: An Informative Guide for Nurses course offered by l’Ordre des infirmières et infirmiers du Québec;
- To receive a caution for failing to provide nursing care to the patient on the basis that his residence was located in an Indigenous community;
- Performance evaluations from her employer(s) from the date of her return to the active practice of nursing; and
- Providing each employer with a copy of the Consent Agreement and Complaints Committee’s decision and advising NANB of any change in address or employer.
